A 20-year-old man had been drinking before he ran over and killed an 85-year-old woman travelling to church on the Sunday morning earlier this year in Winona,[link widoczny dla zalogowanych], Minn.,[link widoczny dla zalogowanych], according to charges filed this week.
Robert J. Tofstad,[link widoczny dla zalogowanych], of Minnesota City,[link widoczny dla zalogowanych], Minn.,[link widoczny dla zalogowanych], was charged Monday in Winona County District Court with criminal vehicular homicide along with other charges in the death of Ruth D. Brendel of Winona.
An initial breath test measured Tofstad's blood-alcohol content at 0.014 percent,[link widoczny dla zalogowanych], based on prosecutors. Tofstad was 19 at the time and not legally permitted to drink.
Tofstad admitted to using had a few drinks the night time before,[link widoczny dla zalogowanych], according to the criminal complaint.
Searching of his vehicle resulted in four unopened beers in a backpack and a "piece of suspect marijuana debris,[link widoczny dla zalogowanych]," the complaint said. Also recovered on the floor near the crash scene would be a tote bag holding a smashed liquor bottle along with a glass jar with what seemed to be two small baggies of marijuana along with a marijuana pipe,[link widoczny dla zalogowanych], the charges read.
Brendel was a lieutenant within the Navy Medical Services Corps in the mid-1950s and then was an occupational therapist for handicapped children,[link widoczny dla zalogowanych].
According to the criminal complaint:
Tofstad was driving into bright sun with a frosted-over windshield and didn't see Brendel crossing from the right,[link widoczny dla zalogowanych]. Witnesses told police they saw Tofstad driving with his go out the window,[link widoczny dla zalogowanych].
Tofstad is also charged with careless driving and underage drunk driving,[link widoczny dla zalogowanych]. He's scheduled to look in the court on Oct,[link widoczny dla zalogowanych].
